1. Definitions
- Website – the website www.HouseForSaleMexico.com, owned by Quality Sales LTD.
- User – any person using the Website, including those browsing listings, registering an account, posting listings, or contacting real estate agents.
- Agent – registered user posting property listings on the Website.
- Client – person seeking properties and contacting an Agent via the Website.
- Administrator – Quality Sales LTD, owner of the Website.
2. Public nature of the Website
The Website is public and accessible to users worldwide.
Users can browse property listings published by Agents and approved by the Administrator.
3. Registration and user account
- Agents must register and log in using their username and password to publish listings.
- Upon registration, the Agent provides an email address and username; in profile editing, they may add a phone number and full name.
- The Website does not openly display email addresses or phone numbers but provides them to Clients interested in the Agent’s property.
4. Fees and commissions
- Posting listings on the Website is free for Agents.
- The Agent must indicate the proposed commission to the Administrator, payable within 40 days of completing a transaction with a client obtained through the Website.
- By posting a listing, the Agent agrees to contact, data processing, and payment of the commission.
- Commissions are payable against an invoice issued by the Website.
- In case of non-payment after a transaction, the Administrator may permanently delete the Agent’s account and listings, block future postings, and pursue legal action to collect the commission.
- The commission on sales is a percentage of the final actual amount obtained by the Agent from the client. The Agent may grant discounts from the advertised price.
5. Posting listings
- The Agent is fully responsible for the content and accuracy of their listings.
- The Administrator may refuse to publish listings already in the system to avoid competition between agents.
- The Agent may not include direct contact details in the listing text, only in designated profile fields.
- Listings expire 6 months after posting unless renewed by the Agent.
- To publish, the Agent must provide a title, price, location, description, photos, PDF documents, property plans, and select options from the listing form.
- Only sales, long-term rentals (min. 12 months), and mid-term rentals (approx. 6 months or longer) are allowed.
- Short-term rentals (nightly stays) are not accepted.
6. Communication
- Communication with the Website is via email: [email protected]
and by telephone. - The Website may contact the Agent to verify data, provide assistance, and connect with clients.
- The Website may contact the Client to conduct satisfaction surveys and provide Agent contact details.
- Users may withdraw consent to communication at any time in accordance with the Privacy Policy.
7. Identity verification
The Website may request identity verification from the Agent through official documents in case of suspected abuse or upon request of law enforcement authorities.
8. Disclaimer of liability
- The Website is not responsible for any loss of profits by the Agent after providing them with a client’s contact information.
- The Website is not liable for any damages arising from the use of the Website.
9. Personal data protection
Data is processed in accordance with the Privacy Policy and the Mexican Federal Law on the Protection of Personal Data Held by Private Parties.
10. Intellectual property
All elements of the Website are protected by copyright. Copying or distribution without the Administrator’s consent is prohibited.
11. Changes to the Terms
The Administrator may amend these Terms at any time.
Users will be notified of changes by email.
